Redundancy payments- 解雇费

A genuine redundancy payment is a payment made to you as an employee who is dismissed because the job you were doing has been abolished - that is, your employer has made a decision that your job no longer exists, and your employment is to be terminated.

Redundancy pay forms part of the National Employment Standards (NES). The NES apply to all employees covered by the national workplace relations system, regardless of any award, agreement or contract.

The NES establish the minimum entitlement to the notice period, or payment in lieu of notice, that an employer must give an employee to end their employment. This applies to all employees (other than casuals), not just those covered by the national workplace relations system.

The NES also outline redundancy pay an employee may receive at the end of their employment. This entitlement only applies to employees covered by the national workplace relations system.

 什么是redundancy payment?



解雇补偿金(redundancy payment)是指你作为一名被解雇(dismissed)的雇员,你所从事的工作已经被取消(abolished),也就是说,你的雇主决定不再雇佣你,你的工作将被终止(your employment is to be terminated)。

在你的雇佣条件结束时,你的雇主根据工业协议(industrial agreement)或雇佣合同(employment contract)要求支付的金额,真正的裁员费可能包括:

payment in lieu of notice(替代通知的薪水)

severance payment of a number of weeks' pay foreach year of service(支付每年数周的工资)

a gratuity or 'golden handshake'(慰劳金或退休金)

遣散费是国家就业标准(National Employment Standards (NES))的一部分。

NES适用于所有受国家工作关系体系(the national workplace relations system)涵盖的员工,无论任何奖励、协议或合同。

NES规定了雇主必须给予雇员终止雇佣关系的通知期(notice period)或替代通知的薪水(notice pay in lieu)的最低限制。这适用于所有员工(临时工除外),而不仅仅是国家职场关系体系涵盖的员工。


 应支付多少遣散费?



雇员根据其在雇主连续服务的时间(continuous period of service)获得遣散费。这一数额是按雇员正常工作时间(ordinary hours worked)的基本工资率(employee's base pay rate)支付的。

雇员的基本工资率(计件工人除外(other than a pieceworker))是指他们在正常工作时间内所获的工资率,但不包括下列各项:

基于激励的支付和奖金(incentive-based payment and bonuses)

货币补贴(monetary allowances)

加班费或罚款(overtime or penalty rates)

其他可单独辨认的金额(any other separately identifiable amounts.)



连续工作时间

*:连续服务至少10年的员工的遣散费将从16周减至12周。这与澳大利亚劳资关系委员会(Australian Industrial Relations Commission)在2004年做出的裁员决定一致。


 遣散费是否适用于所有员工? 



以下员工不领取遣散费:

在雇主连续服务少于12个月的雇员

只工作一段特定的时间的员工

只为特定任务或项目而被雇佣的员工

员工因严重渎职(serious misconduct)而被解雇

兼职员工

只接受为期一年的培训安排的员工(trainees engaged only for the length of the training arrangement)

学徒(apprentices)

小企业的雇员。
